OVERVIEW

This website, available at https://ie.dreametech.com (the “Store”), is operated by DREAME INTERNATIONAL (HONGKONG) LIMITED (“Dreame”, “we”, “us” or “our”). Dreame provides this Store, including the information, tools, products and services available through it, subject to your acceptance of these Terms of Service (the “Terms”) and all policies and notices referenced in them.

Products purchased through this Store are sold directly by DREAME INTERNATIONAL (HONGKONG) LIMITED unless we expressly state otherwise before you place your order.

By visiting the Store or purchasing from us, you use our “Service” and agree to be bound by these Terms, including any additional terms and policies referenced in these Terms or made available by hyperlink. These Terms apply to all users of the Store, including visitors, customers and contributors of content.

Please read these Terms carefully before accessing or using the Store. If you do not agree to these Terms, you must not use the Store or the Service. Nothing in these Terms affects any rights you have under mandatory Irish or European Union consumer law.

Any new features or tools added to the Store will also be subject to these Terms. You can review the current version of the Terms on this page. We may update these Terms in accordance with Section 19.

Our Store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to sell our products and services to you.

SECTION 1 – ONLINE STORE TERMS

To place an order through the Store, you must be at least 18 years old and legally capable of entering into a binding contract. If you allow a minor to use the Store, you are responsible for supervising their use.

You must not use our products or the Service for any illegal or unauthorised purpose or violate any applicable law, including intellectual property laws.

You must not transmit viruses, malware, worms or any other code of a destructive or harmful nature.

We may suspend or terminate your access to the Service if you materially breach these Terms, subject to applicable law.

SECTION 2 – GENERAL CONDITIONS

We may refuse or restrict access to the Service where we have a legitimate reason to do so, including suspected fraud, unlawful activity, security risks or a breach of these Terms. We will exercise this right fairly and in accordance with applicable law.

Content you submit to the Store, other than payment card information, may be transmitted over different networks and adapted to meet the technical requirements of connecting networks or devices. Payment card information is encrypted during transmission over networks.

You must not reproduce, duplicate, copy, sell, resell or exploit any part of the Service, access to the Service, or any contact made available through the Store without our prior written permission, except where permitted by law.

Section headings are included for convenience only and do not affect the interpretation of these Terms.

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We take reasonable steps to ensure that information on the Store is accurate, complete and current. General informational content is provided for reference and should not be treated as professional advice. Nothing in this Section excludes or limits our responsibility for product descriptions, prices or other information that forms part of a contract with you, or any responsibility that cannot lawfully be excluded.

The Store may contain historical information, which is provided for reference only. We may update the content of the Store from time to time.

SECTION 4 – CHANGES TO THE SERVICE AND PRICES

Prices and availability may change before we accept your order. Prices displayed to consumers include VAT where applicable. Any delivery charges or other mandatory charges will be shown before you place your order.

We may modify, suspend or discontinue all or part of the Service. Where reasonably possible, we will provide notice of material changes that affect existing users. Changes to the Service or prices will not affect an order that we have already accepted, except where required by law or agreed with you.

To the extent permitted by law, we will not be liable for changes to, suspension of or discontinuation of the Service that do not affect an existing contract with you.

SECTION 5 – PRODUCTS AND SERVICES

Products and services offered through the Store are supplied directly by Dreame unless we expressly state otherwise. Some products or services may be available exclusively online and may be available in limited quantities.

Returns, exchanges, cancellations and refunds are governed by our Refund Policy and applicable Irish and EU consumer law. For information about delivery, please see our Order and Shipping Policy.

We make reasonable efforts to display product colours and images accurately. However, the appearance of colours may vary depending on your screen and device settings.

We may limit sales or quantities where reasonably necessary, including for stock availability, fraud prevention, regulatory requirements or restrictions on delivery destinations. Any limits will be applied fairly and in accordance with applicable law.

Product descriptions, availability and prices may change before we accept your order. We may discontinue a product at any time. An offer is void where prohibited by law.

Our products must conform to the contract and meet the standards required by applicable consumer law. Nothing in these Terms or our policies excludes or limits your statutory rights, including your rights in relation to faulty, damaged or misdescribed goods.

SECTION 6 – ORDERS, BILLING AND ACCOUNT INFORMATION

When you place an order, you are making an offer to purchase the products in your basket. We may accept or reject an order for a legitimate reason, including product unavailability, an obvious pricing or description error, suspected fraud, payment authorisation failure or delivery restrictions. If we cannot accept your order after payment has been taken, we will refund the amount paid.

We may limit or cancel quantities purchased per person, household or order where reasonably necessary. These restrictions may apply to orders placed through the same customer account, payment method, billing address or delivery address. We may also limit or prohibit orders that reasonably appear to have been placed by unauthorised dealers, resellers or distributors.

If we change or cancel an order, we will use the email address, billing address or telephone number provided with the order to notify you.

You agree to provide current, complete and accurate purchase and account information and to keep that information up to date so that we can process your transactions and contact you when necessary.

SECTION 7 – OPTIONAL THIRD-PARTY TOOLS

We may provide access to tools supplied by third parties that we do not control. Where we do so, those tools may be subject to the third party’s own terms and privacy policy.

Except where prohibited by law, optional third-party tools are provided on an “as is” and “as available” basis without endorsement by us. Your use of them is at your discretion, and you should review and understand the terms that apply before using them.

We may introduce new features, tools or resources through the Store. These will also be subject to these Terms and to any additional terms presented to you.

SECTION 8 – THIRD-PARTY LINKS

The Service may contain links to third-party websites or materials. These links are provided for convenience and do not necessarily mean that we endorse the third party or its content.

We do not control third-party websites and are not responsible for their content, accuracy, availability, products, services or practices. Your use of a third-party website is subject to that third party’s terms and policies.

Please review the applicable third-party terms and policies before entering into a transaction. Questions or complaints about a third party’s products or services should be directed to that third party. Nothing in this Section limits any responsibility we may have under applicable law.

SECTION 9 – USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If you submit reviews, feedback, suggestions, ideas, competition entries or other materials to us (collectively, “Comments”), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, translate, publish and distribute those Comments for purposes connected with operating, promoting and improving Dreame and the Service. This licence does not transfer ownership of your Comments to us.

We are not obliged to keep Comments confidential, pay compensation for them or respond to them unless we have expressly agreed otherwise or applicable law requires us to do so.

We may monitor, edit or remove Comments that we reasonably consider unlawful, offensive, threatening, defamatory, obscene, misleading, infringing or otherwise in breach of these Terms.

You confirm that your Comments do not infringe any third-party rights, including intellectual property, privacy or data protection rights, and do not contain unlawful, abusive or obscene material, malware or misleading information. You must not use a false email address, impersonate another person or misrepresent the origin of your Comments.

You remain responsible for your Comments and their accuracy. Our handling of personal data contained in Comments is subject to our Privacy Policy.

SECTION 10 – PERSONAL INFORMATION

Our collection and use of personal information through the Store are governed by our Privacy Policy. Information about our use of cookies and similar technologies is available in our Cookie Policy on the Store.

SECTION 11 – ERRORS, INACCURACIES AND OMISSIONS

The Store may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, delivery charges, transit times or availability. We may correct such information and update the Store at any time.

If we identify an error in an order you have submitted, we will contact you as soon as reasonably possible. Where appropriate, we will give you the option to confirm the order using the corrected information or cancel it for a full refund. We will not cancel an accepted order solely to avoid our obligations under applicable law.

We are not required to update information except where required by law. A date shown as an update or refresh date does not necessarily mean that all information on the Store has been updated.

SECTION 12 – PROHIBITED USES

You must not use the Store, the Service or its content:

  1. for any unlawful or fraudulent purpose;

  2. to encourage or participate in unlawful acts;

  3. to violate applicable international, EU, national or local laws or regulations;

  4. to infringe our intellectual property rights or the rights of others;

  5. to harass, abuse, threaten, defame, intimidate or unlawfully discriminate against any person;

  6. to submit false or misleading information;

  7. to upload or transmit viruses, malware or other harmful code;

  8. to collect or track another person’s personal information unlawfully;

  9. to spam, phish, pharm, pretext, spider, crawl or scrape the Store without authorisation;

  10. for any obscene or otherwise unlawful purpose; or

  11. to interfere with or circumvent the security features of the Service, the Store, any related website or the internet.

We may suspend or terminate access to the Service for a breach of this Section, subject to applicable law.

SECTION 13 – WARRANTIES AND LIMITATION OF LIABILITY

We do not guarantee that the Store will always be available, uninterrupted, secure or error-free. We may temporarily suspend access for maintenance, security, technical or operational reasons.

Nothing in these Terms excludes or limits:

  1. your statutory rights as a consumer;

  2. our obligation to supply goods and services that conform to the contract;

  3. liability for death or personal injury caused by negligence;

  4. liability for fraud or fraudulent misrepresentation; or

  5. any other liability that cannot be excluded or limited under applicable law.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses where you use the products or Service wholly or mainly for personal purposes.

To the extent permitted by law, general informational content and optional digital features are provided on an “as is” and “as available” basis. This does not affect any express warranty, commercial guarantee or statutory right relating to products or services supplied to you.

SECTION 14 – RESPONSIBILITY FOR MISUSE

You are responsible for losses we reasonably incur as a direct result of your unlawful use of the Service, your intentional misuse of the Store or your material breach of these Terms. This Section does not require a consumer to compensate us for losses that were not caused by the consumer or that it would be unfair or unlawful to recover.

SECTION 15 – SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law or, where necessary, severed. The remaining provisions will continue in effect.

SECTION 16 – TERMINATION

These Terms remain effective until terminated by you or us. You may stop using the Store at any time.

We may suspend or terminate your access to the Service if we reasonably believe that you have materially breached these Terms, engaged in unlawful or fraudulent activity, or created a security risk. Where appropriate and reasonably possible, we will notify you.

Termination of access to the Service does not affect rights or obligations that arose before termination, any order already accepted by us, or your statutory consumer rights.

SECTION 17 – ENTIRE AGREEMENT

Our failure or delay in exercising any right under these Terms does not waive that right.

These Terms, together with the policies and other terms expressly incorporated by reference, constitute the agreement between you and us regarding your use of the Service. They supersede prior communications relating to the same subject matter.

Nothing in this Section excludes liability for fraud or fraudulent misrepresentation or affects any mandatory rights you have under applicable law.

SECTION 18 – GOVERNING LAW AND DISPUTES

These Terms and any contract formed through the Store are governed by the laws of Ireland.

If you are a consumer, this choice of law does not deprive you of any mandatory protection provided by the law of the country in which you habitually reside. The courts of Ireland will have jurisdiction, but if you are a consumer resident in another European Economic Area country, you may also be entitled to bring proceedings in the courts of your country of residence.

If you have a complaint, please contact us first using the details in Section 20 so that we can try to resolve it.

SECTION 19 – CHANGES TO THESE TERMS

We may update these Terms to reflect changes to the Service, our business practices or applicable law. We will post the revised Terms on the Store and update the “Last updated” date. Where required by law, we will provide additional notice or obtain your consent.

Changes will apply from the stated effective date and will not retrospectively change the terms of an order we have already accepted, unless the change is required by law or agreed with you.
